Halle Berry restraining order extended as custody battle with Olivier Martinez enters second week

Olivier Martinez’s temporary restraining order against Halle Berry has been extended through the weekend, as the former couple’s explosive custody battle over their 13-year-old son, Maceo, spills into a second week of hearings at Stanley Mosk Courthouse in Los Angeles (Page Six).

On Friday — the fifth day of proceedings — Martinez, 60, continued closed-door testimony begun on Thursday, doubling down on his claims that Berry, 60, abused him and their son. The claims were made despite cross-examination by Berry’s attorney, Marina Beck, who confronted Martinez with a declaration he signed under penalty of perjury on 30 September 2024 stating there was “no history of domestic violence between the parties” (Page Six).

Martinez’s lawyer, Patrick Baghdaserians, said the 2024 declaration related to a financial request for need-based attorneys’ fees, not the custody dispute (NewsBytes).

Berry’s fiancé, musician Van Hunt, 56, also took the stand on Friday behind closed doors. Berry, who was seen at the courthouse, has vehemently denied the allegations and asked the court to dismiss the restraining order and restore the previous 50/50 physical custody arrangement, while seeking sole legal custody so she can oversee Maceo’s education, therapy and medical care (Page Six).

The proceedings stem from an alleged 26 September incident at Berry’s home, during which Martinez alleges she choked their son — a claim her team calls “entirely meritless and deliberately misleading”. Daughter Nahla Aubry, 18, is expected to testify virtually when the hearing resumes on Monday.
