Greg Lynn denied bail ahead of retrial over alleged murder of camper Carol Clay
Former Jetstar pilot Greg Lynn will remain in custody after Victoria's Chief Justice refused his second bid for bail ahead of a retrial over the alleged murder of Carol Clay.
Former Jetstar pilot Greg Lynn will remain in custody after losing his bid for bail ahead of a retrial over the alleged murder of Victorian camper Carol Clay, the Australian Associated Press reported.
Lynn, 60, is charged with the murder of Clay, 73, who went missing from Victoria’s High Country while camping in March 2020 with her friend Russell Hill, 74. Lynn has repeatedly maintained his innocence, claiming Clay’s death was an accident, AAP reported.
Chief Justice Richard Niall determined on Tuesday that Lynn’s custody conditions and his five years on remand were not exceptional circumstances warranting release, AAP reported. Defence lawyer Dermot Dann KC had argued that exceptional circumstances existed. Lynn told the Victorian Supreme Court about what he described as “disgusting” conditions in custody, including being assaulted with faeces and placed in solitary confinement because it was not safe for him to be around other inmates.
This was Lynn’s second bail application. He sought bail in March, but that application was refused after Justice David Beach found he had not demonstrated exceptional circumstances, AAP reported.
Lynn was granted a retrial in December, with the appeal court finding he had suffered a substantial miscarriage of justice in his first trial, according to AAP. His retrial has been listed to start before Justice Michael O’Connell on May 24, 2027.
